Who is responsible for filing liability claim under renter's insurance?

Thursday, August 26th, 2010

The washing machine I own malfunctioned and flooded part of the apartment I rent. The landlord is billing me for charges incurred for replacing the carpet padding and providing blowers to dry the carpet.

I have renter’s insurance and have been told that the damages should be covered by the liability portion of it.

I asked the rental office’s manager to file a liability claim with my insurance company, but she refuses to do so and wants me to pay the bill right away.

I have also been told that I can not file this claim against myself. Is this information correct? If so, what should I do?
Thanks to everyone. I am clueless in these matters.

I have already reported the incident and an adjuster came over. She denied a claim because none of my belongins were damaged. But I have been told by someone to tell my landlord to file a liability claim against my policy.

Under "Liability Coverages" my policy indicates that "if a claim is made or a suit is brought against any insured because of bodily injury or property damage caused by an occurrence to which this coverage applies, even if the claim is false, we will:
a. pay up to our limit of liability for the damages …"

And under "Peril Insured Agains" it also indicates:
"Accidental discharge or overflow of water … from within a household appliance."

Is there a way they can deny the claim ?

My apartment is requiring $100k property insurance policy for the building if I am at fault. Is this legal?

Thursday, August 26th, 2010

To renew my apartment lease, the management is making me to take out a 100K property liability insurance policy that covers water, fire, smoke, or explosion damage to their building. Is this legal? This policy is not to be confused with renters insurance which would cover my property.

What kinds of things would renter's insurance cover?

Sunday, August 15th, 2010

I just moved into an apartment the other day, and my landlord recommended that I get renter’s insurance. I am a broke college kid, so I am unsure about paying for something like that. Is it really worth paying for?
Thank you, Angie. If nobody can top your answer, I’ll give you the Best Answer!

Can my landlord force my roommate and I to purchase renter's insurance if we don't even have a lease?

Saturday, August 14th, 2010

My roommate and I live in Connecticut in an apartment above a store. We were never presented with a lease agreement, we just pay our rent on the first of the month. The landlord recently told us that we "must" purchase renter’s insurance and that she needs a copy of it once we get it. Can she make us purchase this insurance?
Actually yes, while we would rather not have our things destroyed we both agree that if in the unlikely circumstances there was a fire we would be ok with the loss of our belongings. I should say that we are both on very limited budgets and while renter’s insurance is not that expensive we see it as an unnecessary expense. Also, the landlord has just recently brought up the subject of renter’s insurance a whole 4 month’s after we moved in.

Landlord requestion walk-through of Apartment for "Insurance" purposes?

Saturday, August 7th, 2010

My Landlord just called me out of the blue to tell me he wanted to have a walk-through of the Apartment before the end of the month. He wanted to do it tomorrow, but I pushed for Wednesday (I know legally he must give 48 hours notice). When I asked him why he stated it was for insurance purposes.

We have not been late on any of our rent payments (he in fact has 6 months of post dated cheques) and we have not had any complaints against us from other tenants – anyone have any idea what "insurance purpose" he would be referring to?

I’m not that worried about my side of the house, but my room mate’s room is another story – yet that’s not even what bothers me, it’s just kind of…a bad feeling to have someone root through your stuff.
Title should say "Requesting" – sorry.
